1. Privacy Policy
This Privacy Policy explains how Inclusive Applications ('we', 'us', or 'our') collects, uses, and protects information when you use the Train Check mobile application ('the App').
1.1 Information We Collect
Location Data: The App requests access to your device's GPS location solely to identify nearby Merseyrail stations and display relevant departure information. This data is used in real time and is not stored, transmitted to our servers, or shared with any third parties.
We do not collect: names, email addresses, phone numbers, account credentials, or any other personal identifiable information. Payment information for iOS purchases (£1.99) is handled entirely by Apple and is never seen or stored by Inclusive Applications. The Android version is currently free and no payment information is collected.
1.2 How We Use Your Location
Your location is used exclusively to:
• Identify your nearest Merseyrail station.
• Display walking distance to that station.
• Provide relevant departure countdowns.
Location data is processed entirely on your device and is never stored or sent to external servers by Inclusive Applications.
1.3 Third-Party Data Sources
The App uses real-time train departure data from the National Rail Darwin API and/or the Rail Data Marketplace (raildata.org.uk), operated by the Rail Delivery Group. Your use of train data is subject to their terms of service. We do not control the data practices of these providers.
In accordance with our data licence, Train Check displays a 'Powered by National Rail Data' credit within the App's Settings screen. Live departure data is © Rail Delivery Group and is used under licence for display purposes only. It is not stored, resold, or redistributed by Inclusive Applications.
1.4 Data Retention
We do not retain any personal data. Since no data is collected or transmitted to our servers, there is nothing to delete or request access to.
1.5 Children's Privacy
Train Check is suitable for all ages. We do not knowingly collect personal information from children under the age of 13. Since we collect no personal data at all, the App is inherently compliant with COPPA and similar regulations.
1.6 Your Rights (UK GDPR)
As we do not collect or store personal data, the rights to access, rectify, erase, or port personal data are not applicable in this context. If you have questions about privacy, please contact us at the address below.
1.7 Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of any significant changes by updating the effective date at the top of this document. Continued use of the App after changes constitutes acceptance of the updated policy.

2. Disclaimer
2.1 General
Train Check is an independent third-party application developed by Inclusive Applications. It is not affiliated with, endorsed by, or operated by Merseyrail, Network Rail, the Rail Delivery Group, or any other train operating company or public body.
2.2 National Rail Data Credit
Live departure data displayed within Train Check is sourced from the National Rail Darwin API, operated by the Rail Delivery Group, and is used under licence from the Rail Data Marketplace (raildata.org.uk). In accordance with licence requirements, Train Check displays the following credit within the app:
"Powered by National Rail Data"
Live departure data is © Rail Delivery Group. It is used for display purposes only and is not stored, resold, cached beyond immediate display requirements, or redistributed by Inclusive Applications.
2.3 Accuracy of Information
While we strive to provide accurate and up-to-date train departure information, Train Check relies on third-party data feeds (including the National Rail Darwin API) which may occasionally be subject to delays, inaccuracies, interruptions, or outages. We cannot guarantee that the information displayed in the App is always complete, accurate, or current.
2.4 No Liability for Missed Journeys
Inclusive Applications accepts no responsibility or liability for any loss, inconvenience, or missed journeys arising from the use of or reliance on Train Check. Users should always verify departure times using official Merseyrail sources, announcements at stations, or the National Rail website.
2.5 Service Availability
The App depends on internet connectivity and the availability of third-party data services. We do not guarantee uninterrupted access to the App or the accuracy of data displayed at all times. Planned maintenance, outages, or changes to third-party APIs may temporarily affect functionality.
2.6 Location Services
The App uses GPS location to determine your nearest station. Accuracy is dependent on your device's GPS capability and environmental conditions. We are not liable for errors arising from inaccurate location data.
2.7 Limitation of Liability
To the fullest extent permitted by applicable law, Inclusive Applications shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the App or your reliance on any information provided within it.
2.8 External Links and Services
Train Check may reference or link to external services (such as National Rail or Merseyrail websites). We have no control over the content or availability of those services and accept no responsibility for them.

3.1 Ownership
The Train Check application, including but not limited to its name, logo, design, user interface, graphics, text, and underlying code, is the intellectual property of Inclusive Applications and is protected by copyright law under the Copyright, Designs and Patents Act 1988 (UK) and applicable international copyright treaties.
3.2 Permitted Use
Train Check is available to download on both the Apple App Store and Google Play. On iOS (Apple App Store), the App is available at a one-time purchase price of £1.99. On Android (Google Play), the App is currently free to download, though Inclusive Applications reserves the right to introduce pricing or premium features on Android in the future.
Upon download or purchase, you are granted a limited, non-exclusive, non-transferable licence to install and use the Train Check application on your personal Apple or Android device solely for your own personal use, in accordance with the App Store or Google Play terms.
3.3 Refunds and Purchases
The iOS version of Train Check is a paid application priced at £1.99. All purchases are processed directly by Apple via the App Store. Refund requests are handled in accordance with Apple’s refund policy. Inclusive Applications does not process payments directly and is unable to issue refunds independently of Apple.
The Android version is currently free. If pricing is introduced in future, existing free users will be notified in advance.
If you experience a technical issue that prevents you from using the App, please contact us before requesting a refund so we can attempt to resolve the problem.
3.3 Restrictions
You may not, without the prior written permission of Inclusive Applications:
• Copy, reproduce, or redistribute any part of the App or its content.
• Modify, adapt, translate, reverse engineer, decompile, or disassemble the App.
• Create derivative works based on the App.
• Use the App's name, branding, or visual design for commercial purposes.
• Sell, sublicence, or transfer any rights in the App to any third party.
3.4 National Rail Data — Licence & Credit
Train departure data displayed within the App is sourced from the National Rail Darwin API and is the property of the Rail Delivery Group and respective train operating companies. This data is used under licence from the Rail Data Marketplace (raildata.org.uk) and remains the intellectual property of its respective owners. Inclusive Applications makes no claim of ownership over third-party data.
In compliance with the Rail Data Marketplace licence terms, Train Check:
• Displays a 'Powered by National Rail Data' credit in the App's Settings screen.
• Uses live departure data solely for real-time display to end users.
• Does not store, cache beyond immediate display requirements, resell, or redistribute National Rail data.
• Does not use the data to build or maintain a separate timetable or database.

3.5 Trademarks
'Merseyrail', 'National Rail', and associated logos are registered trademarks of their respective owners. Train Check is an independent application and makes no claim to these trademarks. Their names are referenced solely for informational purposes.
3.6 Infringement
If you believe that any content within Train Check infringes your copyright or intellectual property rights, please contact Inclusive Applications with full details of the alleged infringement so that we may investigate and take appropriate action.
